Terms of Service
These Terms of Service (“Terms”) govern your use of the docpk website, web application, and mobile apps (the “Service”), provided by Diginuance (SMC-PRIVATE) LIMITED (“docpk”, “we”, “us”). By creating an account or otherwise using the Service, you agree to these Terms.
1. Eligibility
You must be a licensed medical practitioner (or otherwise authorised under the laws of Pakistan to prescribe medicines) to use docpk to create prescriptions. By registering, you represent that you meet this requirement and that the information you provide about your identity and qualifications is accurate.
You must be at least 18 years old to open an account.
2. Your account
You are responsible for everything that happens under your account. Keep your password secure. Notify us immediately at [email protected] if you suspect unauthorised access.
One account is for one practitioner. Do not share your login credentials with other doctors or staff.
3. Your responsibilities as a prescriber
docpk is a tool that helps you record and share prescriptions. It is not a substitute for clinical judgement. You alone are responsible for:
- The accuracy and appropriateness of any prescription you issue through the Service.
- Compliance with all laws, regulations, and professional codes that apply to your practice — including those of the Pakistan Medical & Dental Council (PMDC) and any provincial healthcare regulator.
- Obtaining appropriate consent from your patients before adding their personal or health information to docpk.
- The clinical safety of any drug interaction, dose, or duration you choose. docpk may surface helpful prompts but does not perform formal clinical decision support.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including issuing prescriptions you are not legally entitled to issue.
- Upload viruses, malicious code, or attempt to disrupt the Service.
- Attempt to reverse-engineer, scrape, or otherwise misuse the Service or its data.
- Impersonate any person or misrepresent your qualifications.
- Use the Service to harass, defraud, or harm patients or any other party.
5. Pricing & billing
The Service offers a free tier covering your first 30 prescriptions, with no time limit and no payment method required. After 30 prescriptions, continued use requires a paid subscription.
The Practice plan is currently PKR 2,500 per month, billed in advance on a monthly basis to the payment method you provide. Prices are inclusive of any applicable taxes unless otherwise stated. We may change pricing on at least 30 days’ notice, with new prices applying to renewal periods after the notice.
Subscriptions automatically renew each month until you cancel. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. See our Refund Policy.
If a payment fails, we may suspend access to paid features until payment is brought current.
6. Data & privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy. You retain ownership of the patient information and prescription records you enter into docpk. You grant us a limited licence to host, process, and display that information solely to provide the Service to you.
7. Service availability
We work hard to keep docpk available, but we do not guarantee uninterrupted access. The Service is provided on an “as is” and “as available” basis. We may perform maintenance, deploy updates, or temporarily suspend the Service to investigate suspected security issues.
8. Intellectual property
docpk, the docpk logo, and all software, text, design, and other content we provide are owned by Diginuance (SMC-PRIVATE) LIMITED or our licensors. You may not copy, modify, or redistribute any part of the Service except as permitted by these Terms or applicable law.
9. Disclaimers
To the maximum extent permitted by law, docpk disclaims all warranties — express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service is not medical advice. We do not warrant that the Service will be error-free or that any clinical outcome will result from its use.
10. Limitation of liability
To the maximum extent permitted by law, docpk and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service.
Our total aggregate liability arising out of or relating to the Service in any twelve-month period will not exceed the greater of (a) the amount you paid us for the Service in that period, or (b) PKR 30,000.
11. Indemnity
You agree to indemnify and hold harmless docpk and its affiliates from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right — including, in particular, any claim relating to a prescription you issued through the Service.
12. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if we reasonably believe you have breached these Terms, violated any law, or put the Service or other users at risk. We will give you reasonable notice where practicable.
13. Changes to the Service or Terms
We may modify or discontinue features of the Service at our discretion. We may also update these Terms; if we make material changes, we will notify you by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law & disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rawalpindi, Punjab, Pakistan.
